Frequently Asked Questions

Q.      How do I submit an FOI request?

A.      An FOI request must:

-          be in writing (either by letter or in the case of personal requests, e-mail)

-          state that the information is being requested under the FOI Act

-          be addressed to the Freedom of Information Officer, W.I.T.

Q.      What information is available?

A.      Any official information held by public bodies can be sought under the Act. 

        

Q.      Can anyone get access to my personal records?

A.      No, you are the only person who can access your personal records.

        

Q.      What do I do if I receive a letter that requests information under the Freedom of Information Act?

A.      Please date-stamp this letter on receipt and forward it immediately to Laura McGibney, FOI Officer.  Please ensure to forward the request in a sealed envelope.

        

Q.      What if I receive a letter requesting information but that does not specify the FOI Act?

A.      Deal with it as you would have done pre-FOI, ensuring to comply with existing policies and procedures in place in W.I.T.  If the information requested is not routinely available, please advise the requester to contact the FOI office – Ext. 2608, e-mail: foi@wit.ie.

        

Q.      Are my e-mails subject to FOI?

A.      Yes, e-mails are considered “records” and all “records” are subject to the FOI Act 1997.  Likewise, all files on your PC, printed documents, notes written/typed on any form of paper, voicemail, video recordings etc.

        

Q.      Do I need to change how I store my records?

A.      While the efficient and uniform storage of records would greatly enhance the general running of W.I.T., the FOI Act does not determine how records are stored.  This would be addressed within the policies and procedures of W.I.T.  The FOI Act simply makes existing records available to the public.  However, please consult our Records Retention Policy for guidance on the storage of records.

        

Q.      Can anyone ask for reasons for decisions?

A.      A person who is materially affected by a decision may request reasons for that decision. This is a different type of request than the regular request for records. It is a Section 18 request. An application form is available here
